         <title>Son as a &quot;non permissive&quot; driver may be heading to criminal court</title>
         <description><![CDATA[<p style="text-align: justify;"><img style="float: right; margin: 0 0 20px 20px;" title="He's a non-permissive driver is he? " src="http://www.theiowaedict.com/shooting-oneself-in-the-foot.jpg" alt="shooting-oneself-in-the-foot.jpg" width="300" height="300" />I get a lot of questions and this week was no exception. Here a mother wrote to me because her son was involved in an intersection collision with another high schooler. The other kid ran a stop sign and t-boned her car. Progressive insured the other driver and apparently is claiming the son was a non permmissive driver and they will not provide insurance coverage. Really? You know where Progessive likely heard that story from.&nbsp;</p>
<p style="text-align: justify;">If that young driver's parents are claiming he didn't have permission to drive, they are likely saying this to avoid paying, thinking this will do an end run on the insurance claim. Well, they are likely making a big mistake. Here's why.</p>
<div style="text-align: justify;">If he was driving without permission then didn't he steal the car? As a lawyer my first question will be whether they turned junior in to the police as the driver of a stolen vehicle. If he didn't have permission to be driving then he stole the vehicle and should be charged criminally.</div>
<div style="text-align: justify;">So as a coddling and entitlement mentality parent consider the consequences before doing the wrong thing. The next time a parent wants to teach a kid how to avoid responsibility think it through and exactly what you're teaching your son.</div>
<div style="text-align: justify;">You can't have it both ways, you can't avoid financial responsibility for negligence by claiming the driver wasn't given permission to use the car and avoid criminal sanctions for theft. That Participation Trophy won't be handed out in real life; only on the soccer field.&nbsp;</div>

         <title>Ames, Iowa - College Town USA - Fall From Balcony Kills Man who Fell - 3 Strikes and the Landlord&apos;s Out</title>

<li>2006 Benjamin Peterson died from a similar fall at this complex</li>
<li>Drinking may have been involved.</li>
<li>This isn't rocket science.</li>
</ul>
<p style="text-align: justify;">Is there something about the design that increases the risk of a fall? Should design changes be added, such as steel bars or ornamental screens? Come on landlord this isn't rocket science. If it's a foreseeable risk the landlord has an obligation to act to protect the residents and guests. Granted you'd probably never think it will happen twice, but now that it did, will it be three strikes and you're out?&nbsp;</p>
<p style="text-align: justify;">Balcony falls aren&rsquo;t all that uncommon - in other words they are foreseeable. In this apartment building I'd say they are really foreseeable. Here are a few news articles, but let's start off with a video of a young toddler that falls and lives.</p>

         <title>Texting and situational blindness</title>
         <description><![CDATA[<p style="text-align: justify;"><img style="float: right; margin: 0 0 20px 20px;" title="Oink-oink... Don't forget to buy tickets to the Iowa State Fair!" src="http://www.theiowaedict.com/DSC00560-1.JPG" alt="DSC00560-1.JPG" width="316" height="211" />The Iowa State Patrol&rsquo;s investigation is complete and the conclusion is another teen has died due to situational blindness brought on by distracted driving. The report concludes this 17-year old was <a href="http://www.kcci.com/news/30425618/detail.html">texting</a> while driving taking her attention away from the road and allowing her car to run into the back end of a school bus three miles east of St. Ansgar. This young lady was a junior at St. Ansgar High School. The accident occurred at 3:24 pm on November 1<sup>st</sup>, 2011 on Iowa&rsquo;s Highway 218.</p>

Her crash was a single car event in which the passenger who was wearing a seat belt walked away from the accident. She was 18-year-old Emily M. <p><strong>Alexis Summers</strong> - We don&rsquo;t have to far to find another teen, this one <a href="http://www.wtae.com/r/29659463/detail.html">a 17 year old cheerleader</a> from Knock High School in Saxonburg, Pennsylvania who died at 10:00 pm on Hannastown Road in Jefferson Township, Butler County.</p>

         <title>Do I have any legal recourse after an auto accident if I was not seriously injured? </title>
         <description><![CDATA[<p style="text-align: justify;"><strong><img style="float: right; margin: 0 0 20px 20px;" title="No participation trophys" src="http://www.theiowaedict.com/Gladiators.jpg" alt="Gladiators.jpg" width="400" height="266" />Question:</strong> Do I have any legal recourse in an auto accident if I was not injured? I am a truck driver involved in an accident in a company truck. The other driver admitted to being at fault along with two witnesses that stated it was his fault. He had minor injuries and was taken to the hospital. I had a stiff neck for a few days, but did not seek medical attention. I was laid off a week later. I had a clean driving record until this happened. Now I'm having a hard time getting driving jobs because of this accident. Do I have any legal recourse against the other driver from this accident?</p>]]><![CDATA[<p><strong>Answer:</strong> Well no. In every personal injury action, which the law calls a "tort" you need four things before you are allowed to sue and to proceed.</p>
<p style="padding-left: 30px; ">1. A duty.</p>
<p style="padding-left: 30px; ">2. A breach of the duty.</p>
<p style="padding-left: 30px; ">3. Damages.</p>
<p style="padding-left: 30px; ">4. Your damages need to be proximately caused by the negligence of the "tortfeasor" the wrongdoer.</p>
<p>In your case you are simply missing 3 and 4. You have no damages and therefore no damages were proximately caused by the wrongdoer. Your personal injury is what the law refers to as de minimis. Lay people would use <a href="http://en.wikipedia.org/wiki/De_minimis">this definition</a> and lawyers this <a href="http://legal-dictionary.thefreedictionary.com/De+Minimis">one</a>. Frankly it was what the McDonald's marketing machine was all about but they were completely wrong and fooled most people into believing the sky was falling.</p>
<p style="padding-left: 30px;">De minimis&nbsp;is a&nbsp;<a title="Latin" href="http://en.wikipedia.org/wiki/Latin">Latin</a>&nbsp;expression meaning&nbsp;about minimal things, normally in the locutions&nbsp;de minimis non curat&nbsp;<a title="Praetor" href="http://en.wikipedia.org/wiki/Praetor">praetor</a>&nbsp;("The praetor does not concern himself with trifles") or&nbsp;de minimis non curat lex&nbsp;("The law does not concern itself with trifles").<a href="http://en.wikipedia.org/wiki/De_minimis#cite_note-0">[1]</a><a href="http://en.wikipedia.org/wiki/De_minimis#cite_note-1">[2]</a></p>
<p style="padding-left: 30px;">In&nbsp;<a title="Risk assessment" href="http://en.wikipedia.org/wiki/Risk_assessment">risk assessment</a>&nbsp;it refers to a level of risk that is too small to be concerned with. Some refer to this as a "virtually safe" level.<a href="http://en.wikipedia.org/wiki/De_minimis#cite_note-2">[3]</a></p>

<p style="padding-left: 30px;">In a lawsuit, a court applies the&nbsp;de minimis&nbsp;doctrine to avoid the resolution of trivial matters that are not worthy of judicial scrutiny. Its application sometimes results in the dismissal of an action, particularly when the only redress sought is for a nominal sum, such as one dollar. Appellate courts also use the&nbsp;de minimis&nbsp;doctrine when appropriate.</p>

<p>But the personal injury aside you did also mention a wage loss being caused by your having a tough time keeping a job. It didn&rsquo;t take me 30 years of practice to know it&rsquo;s going to be extremely difficult to prove you&rsquo;re not being able to find any truck driving job is somehow proximately caused by this one little accident. There must be more than you&rsquo;re telling me; either that or you aren&rsquo;t trying hard enough to find work.</p>

         <title>When is enough, well .... not enough?</title>

The guys hand was broke now we have to pay for the surgery and everything else. I offered that day to take him to get his hand x-rayed. He declined and then two days later took himself to the ER and found out it was broken then had to have surgery to put pins in it. I offered to help pay and have paid him $300 so far. Now his next bill he wants me to pay is $1030 and that doesn't included surgery bills yet. He said he will sue me if I don't pay all of his bills. When is enough enough?</p>]]><![CDATA[<p style="text-align: justify;"><strong>Answer:</strong> You can be held liable for causing another to become injured. It appears as though you admit to having injured the other guy; the question is whether or not you were negligent when you injured him. There are not enough facts mentioned for any lawyer to say one way or the other. We would need more facts to be able to really answer your question with any confidence. And to answer your question, enough is enough when a negligent person who is liable pays for all the damages.&nbsp;</p>]]></description>

         <title>FIFTY WAYS TO FIND LEGAL WORK AND EARN A LIVING AS A PRACTICING LAWYER</title>

<p>We have way too many lawyers out of work with not enough open positions to hire them all. If you're  one of the unemployed lawyers you must be asking,<strong><em> how can you get a law related job or how can you get back to work?</em></strong> Let's explore that issue today.</p>

<p>Just keep in mind that you were <a href="http://www.youtube.com/watch?v=pvmc58Q2AOk">born in the USA</a>... and whining isn't allowed; being tough is though.</p>

<div style="text-align: justify;">First I'm going to say, stop ya whining and griping about law schools and how  they defrauded you and promised you the moon if you would only pay them $150,000.  Let's face it no one twisted your arm to apply to law school. You did it  voluntarily. What you are finding out is what we all figured out shortly after  leaving law school. That if they paid us what we were worth they would get free  labor. My first job was in Waterloo, Iowa. It paid me $17,500 per year in salary, no overtime, no benefits and one weeks paid vacation. When I asked Jim Hellman what hours I was supposed to work he said, <em>"You're expected to work as long as it takes you to get your work done."</em> Fair enough... My student loans were $470 per month, I had three rug rats running around and one on the way. I had no clients, no resources but I was hungry and woke up the same way every morning - <em><strong>I was afraid to be poor.</strong></em> But what I did have was a bar card, knowledge, skills to research and write with an ability to argue a point. And so do you, so stop griping about no one handing you a participation trophy and get busy learning how to be a practicing lawyer.&nbsp;</div>

<div style="text-align: justify;"><em>Get used to it, in real life no one is handing out participation trophies. As one elderly woman once said to me, "There's nothing wrong with this younger generation that a good depression wouldn't cure."&nbsp;</em></div>
</blockquote>
<div style="text-align: justify;">So stop the whining and get busy; your first job is to get busy learning how to be a practicing lawyer and learning  skills that will make you a lawyer and a valuable one. After all, let's face it  you have near zero skills, no clients, no experience and at this point a bad  attitude. So leave the attitude behind and let's get busy mending fences so you  become presentable.</div>

<div style="text-align: justify;">1. Start your own firm.</div>
<div style="text-align: justify;">2. Volunteer at a firm to get your foot in the door.</div>
<div style="text-align: justify;">3. Work, even if you have to volunteer, at Legal Aid to gain experience,  learn how to try a case, how to win, how to deal with clients and get to meet other lawyers in the  courtroom and out.</div>
<div style="text-align: justify;">4. Read about someone's case, research the issues and send it to the first  chair lawyer.</div>
<div style="text-align: justify;">5. Volunteer to assist a County District Judge with research to get  yourself into a courtroom, make a friend in the court system who can then sell  you, your skills and your determination to be a lawyer. Show some guts and determination.</div>]]><![CDATA[<p>6. Create a niche blog, research the law and write daily one article of  legal significance to get you known and to create a resume builder that will  sell you.</p>
<p>7. Apply in every state agency that has legal jobs.</p>
<p>8. Apply to every insurance company for a claims job adjusting claims.&nbsp;</p>
<div>9. Check with the State Bar Association for job postings.</div>
<div>10. Check daily with the every law school placement center in your state  and the state where you would consider moving.</div>
<div>11. Write a Law Review article and submit it for publication.</div>
<div>12. Write guest blogs for practicing attorneys with a working blog.</div>
<div>13. Create a niche business, like service of process or legal investigation  services, that get you in the profession doing something useful.</div>
<div>14. Go through the Iowa Code and locate every section that will allow the  winner attorney fees as a part of the recovery. Then, after you research and  understand the law, market yourself on the Internet and to law firms in that  area.</div>
<div>15. Market yourself as a lawyer who will do work other lawyers either don't  want to do, can't do or don't have the time to do. (i.e., small claims, FED  actions, nuisance actions, small divorces, collections work, etc.)</div>
<div>Let's face it, if all you gotta worry about is unemployment you're luckier than some. Remember Vietnam?</div>
<div>16. Offer to write posts for lawyers with blogs who don't have the time to  market.</div>
<div>17. Write articles and letters to the editor explaining legal issues to get  yourself known in the community.</div>
<div>18. Join the Chamber of Commerce and attend the meetings to get to know the  local leaders who may have a lead where you can get a job.</div>
<div>19. Check all area prosecutor's offices to see if they have part time  positions available.</div>
<div>20. Volunteer at the State Bar Association.</div>
<div>21. Attend every job's fair you can find.</div>
<div>22. Read the newspaper want ads.</div>
<div>23. Get in the Internet and locate every website that advertises legal  jobs.</div>
<div>24. Get acquainted with every headhunter in your city and town.</div>
<div>25. Contact legal headhunters online and ask them via email, what else you  can do and where you should look for a legal job.</div>
<div>26. Add sensible, not angry or sour, and intelligent, thoughtful comments  on legal blogs.</div>
<div>27. Contact the State unemployment agency and register for email  notifications for open positions.</div>
<div>28. Take something, anything legal in nature that will give you experience  and something else to talk about besides the amount of your student loans and  how you got ripped off by the law school.</div>
<div>29. Call every insurance company you can locate on a daily basis asking  about openings.</div>
<div>30. Apply for a teaching position at a community college or for-profit  secondary school to teach legal classes.</div>
<div>31. Apply for a teaching position at the State Real Estate Commission  Continued Education and Licensing classes. Offer to teach the legal  classes.</div>
<div>32. Go online, visit blogs where lay people ask legal questions; answer the  questions and offer to assist for a reduced fee.</div>
<div>33. Register, take the classes and then market yourself as a low-cost  mediator for divorce cases.</div>
<div>34. Advertise, ethically, to do flat-fee divorces, small claim cases and  landlord-tenant disputes.</div>
<div>35. Offer to work for nothing in a law office if they will teach you how to  handle certain kinds of cases. (i.e., workers' compensation, small claims,  divorce, family law, bankruptcy, landlord-tenant types of case.)</div>
<div>36. Learn how to handle and then advertise your services to do bankruptcy  work.</div>
<div>37. Send a letter out to as many lawyers as you can locate offering to take  any small cases they do not want.</div>
<div>38. Send letters to lawyers offering to handle their 'fish files'.</div>
<div>39. Offer to teach research and writing at the local law school.</div>
<div>40. Contact local unions and factories where immigrants like to work, then  hold free Q&amp;A sessions on Saturday mornings. You'll meet people with  problems and you will pick up cases.</div>
<div>41. Take out an ad in the local shopper offering your services.</div>
<div>42. Contact nursing homes and offer a Q&amp;A session for the elderly on a  weekly basis.</div>
<div>43. Put up an ad at the local super market bulletin board or the local  taverns offering low rates for standard legal services.</div>
<div>44. Take out an ad in every church bulletin you can locate. They are cheap  and people who need confession also usually need lawyers.</div>
<div>45. Offer a low cost brief writing service.</div>
<div>46. Offer a low cost research service.</div>
<div>47. Change your attitude. If you're really angry see a counselor, get  medicated, workout and get over it; life isn't fair and no one said it was  going to be fair.</div>
<div>48. Get in good physical condition; work out daily. At least walk and stop  shoving the food in your pie hole.</div>
<div>49. Get your financial affairs in order and if you don't know how to start  seek advice. Hell, call me and I'll try to help you figure it out. Let's face it  not all those student loans you owe were spent on your education. My guess is  you bought fashionable clothes, iPods, iPads, beer, partied, went on vacations,  had cable TV, iTune purchases, weekly Netflix, a cell phone, smoked and wasted a  lot of what you borrowed. One elderly lady once said to me, "There is nothing  wrong with this generation that a good depression won't cure." If this is too  much to handle go to number 50.</div>
<div>50. Stop whining and get busy figuring out your life and how to earn a  living. You've go marketable skills so now it's time to learn how to use them.</div>
<div>51. Do something else where legal skills are somewhat important but not the  main qualification for the JOB.</div>
<div>52. Write and sell boilerplate forms online.</div>
<div>53. Write personnel manuals for corporations.</div>
<div>54. Run for Congress, pass laws that forgive all the student loans instead of the banksters and privateers making a fortune on ripping off the public. Can you imagine how many homes students would have bought if instead of bailing out the banksters we agreed to pay off all student loans? Hell, the students would have lined up to buy house and then headed to the shopping malls to buy furniture and all the stuff I'm selling at our downsizing sale.</div>

         <title>Trailer Comes Loose from Semi and Strike&apos;s Vehicle Head-on - Who is to blame?</title>
         <description><![CDATA[<p style="text-align: justify;"><strong><img style="float: right; margin: 0 0 20px 20px;" title="Towing Trailer Comes Loose - Head On Collision" src="http://www.theiowaedict.com/Trailer%20Hitch%20Diagram.jpg" alt="Trailer Hitch Diagram.jpg" width="300" height="193" />Hancock County, Iowa </strong>- I&rsquo;ve been reading about these accidents and one guy has a blog dedicated to accidents where trailers become unhitched and crash into other cars, trucks or motorcycles. It&rsquo;s been awhile since I&rsquo;ve seen one in Iowa, right up until this week, that is. It happened on December 5, 2011 at around 5:58 a.m. on Highway 18 about 2 miles west of Garner. A 2000 Peterbuilt semitruck pulling a trailer (driver shown on police report as being from Garner, Iowa &ndash; 38 years old) was westbound on Highway 18 when as the officer describes it, <em>&ldquo;VEHICLE 1 (THE SEMI ) WAS WESTBOUND ON HWY 18 WHEN ITS TRAILER BECAME DETACHED FROM THE TRACTOR THE TRAILER THEN SLID ACROSS THE CENTER LINE AND STRUCK THE EASTBOUND VEHICLE 2 HEAD ON.&rdquo;</em></p>
<p>The eastbound vehicle is a Ford Explorer being driven by a 56 year old man from Britt, Iowa. From the report it appears as though the opposing driver died in the crash.</p>

         <title>What are risks today, that will kill workers while on the job tomorrow?</title>
         <description><![CDATA[<p style="text-align: justify;"><img class="mt-image-right" style="float: right; margin: 0 0 20px 20px;" src="http://www.theiowaedict.com/augers.JPG" alt="augers.JPG" width="325" height="325" />To answer that question let&rsquo;s look at some of the recent accidental deaths while on the job.</p>
<ul>
<li>In the first case out of <strong>Salt Lake City</strong> a worker identified as Kelton Lee (55) a construction worker who was lifting a heavy piece of pipe when his legs gave out and the pipe struck him in the head. Although he regained consciousness he later died of the head injuries. Read more <a href="http://www.vernal.com/stories/Vernal-man-dies-after-industrial-accident,2054821">here</a> from the Vernal Express.</li>
<li>Next we go to <strong>South Dakota</strong> where an article discusses the number of deaths in that state. It&rsquo;s interesting that all workers killed in South Dakota last year were men; men must be taking more jobs with higher risk of injury. Here is a quote from that article.&nbsp;<em>&ldquo;All but one of those killed in South Dakota last year were men. The Labor Statistics bureau groups farming with forestry, fishing and hunting, and that sector had the highest number of worker deaths, 14. The construction industry followed with seven.</em></li>
<li><em>Every year since 2003, driving associated with work has been as dangerous as or more dangerous than fatal accidents involving equipment or objects and falls. Among fatalities last year, 16 were caused by transportation accidents, including nine highway deaths and seven nonhighway accidents.</em></li>
<li><em>Ten deaths occurred in accidents involving objects and equipment and five were caused by falls.</em></li>
<li><em><strong>South Dakota</strong> closely tracks a national trend regarding transportation fatalities. Nationwide, 21 percent of the 4,547 people killed on the job last year died in highway accidents. The nine highway deaths in South Dakota represents 25 percent of the total work-related deaths.</em></li>

<li>Heading east to Vermont we pick up an article out of <strong>Guilford, Vermont</strong> and Reformer Staff Writer, Chris Garofolo. He writes about a man killed when the tractor he was driving overturned, crushing him to death. People describe that accident as a freak accident but that I find hard to believe. First did the tractor have rollover protection? Second did the tractor have a seat belt and was the driver wearing it? Last thing to consider is speed and how unlevel the terrain he was riding on and what he was doing on it. While this is a tragic accident it&rsquo;s more than likely one that can be prevented. <li>Heading to<strong> New York </strong>we have an article titled &ldquo;Architects of Brighton Beach condo in deadly collapse had history of flouting regulations.&rdquo; I&rsquo;m not sure of the facts so I won&rsquo;t comment because this accuses people of flaunting safety rules and without knowing the details it&rsquo;s not for me to comment on. But what we can surmise from what is said is that a building collapsed during construction and some workers were injured and one was killed. <li>In Spring Hill near <strong>Tampa, Florida</strong> a <a href="http://www2.hernandotoday.com/news/news/2011/nov/09/3/construction-worker-killed-along-spring-hill-drive-ar-301855/">road construction worker</a> was struck by a motorist driving though a highway construction zone. We&rsquo;ve represented road crew workers in several injury related accidents.</li>
<li>In a similar type of accident a highway construction worker along I077 in <strong>Brecksville, Ohio</strong> was struck and killed when a semi-truck slammed into him. The worker, John Costlow of Akron was installing signs off the roadway when a semi went off the road, struck and killed him. <li>Just one more and we are done for today. We go to <strong>Queensland and Melbourne</strong>, <strong>Australia</strong>. A worker was trapped under a &ldquo;heavy load&rdquo; and it killed him.          <title>Child School Bus Driver&apos;s Under Scrutiny</title>
         <description><![CDATA[<p style="text-align: justify;"><img style="float: right; margin: 0 0 20px 20px;" src="http://www.theiowaedict.com/Bus%20School%20Bus%20Drivers.jpg" alt="Bus School Bus Drivers.jpg" width="332" height="236" />A recent school bus accident that killed an 11-year-old boy and another accident striking an 84-year-old pedestrian have school officials evaluating their fleet drivers. No driver can have a squeaky clean driving record, but there shouldn&rsquo;t be anything that makes one conclude their driving, based on past issues, would endanger the children or other pedestrians.&nbsp; While I think the effort is a good one, I don&rsquo;t think the article sheds light on what convictions should keep a person from driving a school bus once they pass the standard qualifications.</p>

         <title>Civil and criminal compression asphyxia, the curious case of Michaela McAreavey</title>
         <description><![CDATA[<p style="text-align: justify;"><img class="mt-image-right" style="float: right; margin: 0 0 20px 20px;" src="http://www.theiowaedict.com/Evidence.jpg" alt="Evidence.jpg" width="400" height="290" />Compression asphyxia is a cause of death I see in both civil and in criminal cases. So it's one lawyers need to pay attention to. The scope of this diagnosis or when used to pronounce a person&rsquo;s death can differ. It can be compression to the chest, heart or throat with such force as to stop the person from breathing; leading to their untimely death. Often quoted by the public as <em>strangulation</em>, for the law that is too general of a way of describing compression asphyxia. Asphyxia may be from natural, accidental or from intentional causes. The acts leading up to compression asphyxia is present in both civil personal injury cases in truck accidents or work place accidents and in criminal cases involving some form of homicide. In researching this medical condition I stumbled upon a tribute to Michaela McAreavey nee Hart with several video clips on YouTube. While I can&rsquo;t be sure of the facts generated by the investigation the caption reads: &ldquo;<em>Michaela McAreavey nee Harte murdered during her honeymoon in Mauritius.</em> &ldquo; With what's been going on in Aruba this case catches attention for many reasons the most obvious being that no one anticipates death while starting out life following such a joyful occassion as one's wedding. Technically here is compression asphyxia defined.</p>

<p style="padding-left: 30px; text-align: justify;"><strong><span style="text-decoration: underline;">DEFINITION</span></strong></p>
<p style="padding-left: 30px; text-align: justify;">The physiological definition of "asphyxia" is complex and often means more than hypoxia.&nbsp; In the field of forensic pathology, asphyxia is considered to be a consequence of a struggle to breathe against some mechanical interference with respiration.</p>
<p style="padding-left: 30px; text-align: justify;"><span style="text-decoration: underline;">General Autopsy Findings in Asphyxial Deaths</span></p>
<p style="padding-left: 30px; text-align: justify;">The following are general findings in death by asphyxia.&nbsp; Their prominence will vary with individual cases and petechial hemorrhages, in particular, may be completely absent, or extremely rare.&nbsp; It is also important to note that all of the findings in asphyxial deaths may be found, on occasion, in other circumstances.</p>
<p style="padding-left: 30px; text-align: justify;">1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Pulmonary edema, with froth in trachea and bronchi.</p>
<p style="padding-left: 30px; text-align: justify;">2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Bulky, crepitant and over‑distended lungs.</p>
<p style="padding-left: 30px; text-align: justify;">3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Right ventricular dilatation.</p>
<p style="padding-left: 30px; text-align: justify;">4.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Petechial hemorrhages on the conjunctival and facial tissue, usually above the level of the airway obstruction in strangulation cases.</p>
<p style="padding-left: 30px; text-align: justify;"><span style="text-decoration: underline;">Suffocation</span></p>
<p style="padding-left: 30px; text-align: justify;">Suffocation results from the mechanical obstruction to the entry of air into the lungs by obstruction of the external respiratory orifices.&nbsp; Common agents used are plastic bags, soft pillows, or soft materials used to occlude the mouth and nostrils.</p>
<p style="padding-left: 30px; text-align: justify;">Smothering can be homicidal, suicidal, or accidental.&nbsp; In homicidal suffocation, there is usually considerable physical disparity between the assailant and victim, or the victim is debilitated by drugs or injury.</p>
<p style="padding-left: 30px; text-align: justify;">Scene investigation may not be helpful.&nbsp; Some cases of Sudden Infant Death Syndrome have been erroneously attributed to overlying by the mother.</p>
<p style="padding-left: 30px; text-align: justify;">The autopsy findings are subtle and injuries may be completely absent.&nbsp; Examination of a suicidal death by suffocation with a plastic bag usually reveals moisture on the face and on the inner surface of the bag.</p>
<p style="padding-left: 30px; text-align: justify;">In homicidal suffocations, there may be fingernail scratches, or bruises to the face, or tears to the buccal mucosa.&nbsp; There may be marks associated with use of a tape or a gag.&nbsp; If neck compression does not occur, petechial hemorrhages may not be found.&nbsp; The diagnosis of suffocation may be impossible to establish with certainty on the basis of the postmortem examination alone.</p>
<p style="padding-left: 30px; text-align: justify;"><span style="text-decoration: underline;">Upper Airway Obstruction (Choking)</span></p>
<p style="padding-left: 30px; text-align: justify;">The usual mechanisms of asphyxia in choking are mechanical obstruction of the airway, usually involving the pharynx, larynx and trachea.</p>
<p style="padding-left: 30px; text-align: justify;">The most common situation is the so‑called "cafe coronary".&nbsp; Victims are usually intoxicated, or have pre‑existing neurological debilitation.&nbsp; Choking occurs suddenly while eating.&nbsp; The obstructing foreign body may be removed prior to autopsy.&nbsp; Children may choke on small toy objects, nuts or grapes.</p>
<p style="padding-left: 30px; text-align: justify;">The vast majority of choking deaths are accidental.&nbsp; Suicides and homicides occur very rarely.</p>
<p style="padding-left: 30px; text-align: justify;">Inhalation, or aspiration, or gastric contents as a primary event is extremely unusual.&nbsp; When aspiration occurs, drugs, such as alcohol, a head injury, or serious neurological disease process should be sought.&nbsp; Significant aspiration of gastric contents during an epileptic seizure is relatively unusual.</p>
<p style="padding-left: 30px; text-align: justify;">The autopsy findings in choking, again, may be subtle, particularly if the occluding object has been removed.&nbsp; Petechiae may be present if significant retching has occurred.&nbsp; There may be injuries to the buccal mucosa, related to resuscitation.&nbsp; The right ventricle of the heart is dilated and the lungs hyperinflated and possibly edematous.&nbsp; Inhalation of blood may play a significant accelerating role in trauma cases, such as those associated with facial fractures.&nbsp; Aspiration is usually the mechanism of death and not the cause of death and a complete autopsy and toxicological examination are necessary to identify these modifying factors.</p>
<p style="padding-left: 30px; text-align: justify;"><span style="text-decoration: underline;">Hanging</span></p>
<p style="padding-left: 30px; text-align: justify;">As in most asphyxial deaths, hanging can be suicidal, accidental, or homicidal, but suicidal hangings are by far the most common.</p>
<p style="padding-left: 30px; text-align: justify;">Hanging deaths result from compression of the airway and neck vessels as a result of suspension in such a manner that the force acting on the ligature is that of all or part of the weight of the body.</p>
<p style="padding-left: 30px; text-align: justify;">Examination of the scene is important.&nbsp; The posture, position and method of hanging and ligature used must all be examined and injuries, other than those attributable to hanging, require careful assessment and interpretation.&nbsp; It is important to remember that complete suspension is not necessary.&nbsp; In most hanging deaths, the ligature and ligature mark lie above the thyroid prominence, with a point of suspension usually behind one ear.&nbsp; Frontal knots are unusual.&nbsp; The appearance of the ligature mark varies with the type of ligature used and with the physical characteristics of the individual neck.&nbsp; Soft broad ligatures may not leave any recognizable marks.&nbsp; In most cases, the ligature does not completely encircle the neck.</p>
<p style="padding-left: 30px; text-align: justify;">Successful hanging can be accomplished in a variety of positions, including a semi‑reclining sitting or lying position.&nbsp; The only requirement is for sufficient sustained pressure to be applied to the neck.</p>
<p style="padding-left: 30px; text-align: justify;">The findings at autopsy and hanging include the ligature mark, which is usually abraded and parchmented and may, depending on the ligature used, show specific patterning.&nbsp; The deepest furrow is opposite the point of suspension and fades as it approaches the knot.&nbsp; Scratches, in relation to the ligature mark, with the appearance of fingernail scratches, should be documented and investigated.</p>
<p style="padding-left: 30px; text-align: justify;">Petechial hemorrhages are usually completely absent, when the full weight of the body acts on the ligature, but are present in varying degrees of prominence, when the victim is only partly suspended.&nbsp; Layered neck dissection usually shows completely absent, or only minimal, bruising into the soft tissue.&nbsp; Dissection of the carotid arteries may show occasional linear traction type tears.&nbsp; Fractures of the vertebrae do not occur unless there is a significant drop, such as a judicial hanging.</p>
<p style="padding-left: 30px; text-align: justify;">Accidental hangings are far more common in children, than in adults.&nbsp; They are frequently the result of articles of clothing caught up in machinery.</p>
<p style="padding-left: 30px; text-align: justify;">Auto‑erotic asphyxial deaths usually involve males and occur in isolated or secluded sites.&nbsp; There may be evidence of transvestitism, bondage, mirrors, cameras, etc.</p>
<p style="padding-left: 30px; text-align: justify;"><span style="text-decoration: underline;">Ligature and Manual Strangulation</span></p>
<p style="padding-left: 30px; text-align: justify;">Strangulation results when the application of a constricting force to the neck is such that the force exerted is other than that of the weight of the body.&nbsp; The two types of strangulation include manual strangulation and strangulation by ligature.&nbsp; The victims are usually women, children, or the elderly.&nbsp; Ligature suicides can occur, but the ligatures must be fashioned in such a manner that the pressure on the neck is maintained after loss of consciousness.</p>
<p style="padding-left: 30px; text-align: justify;">At autopsy, in cases of ligature strangulation, the ligature mark is usually horizontal and crosses the neck in the region of the lower end of the thyroid cartilage.&nbsp; Particularly with ridges on thin ligatures, a furrowed mark will be evident.&nbsp; Large bulky ligatures may not leave any surface evidence of injury to the neck.&nbsp; Petechial hemorrhages to the face and conjunctiva are usually prominent, as are the usual signs of asphyxia in the lungs and heart.&nbsp; A layer by layer dissection of the neck should be performed, with the neck incision extending up to the level of the mastoid processes.&nbsp; Serial photographs should document the distribution and pattern of bruising to the soft tissue and muscle.</p>
<p style="padding-left: 30px; text-align: justify;">Pure ligature strangulation is relatively uncommon and there is usually an associated manual component.&nbsp; Consequently, fractures of the hyoid and thyroid are seen, due to compression of these structures against the cervical vertebrae.&nbsp; Other associated injuries should be carefully sought for and documented, such as scratches to the face, or neck, or bruising to the extremities.&nbsp; Evidence of an associated sexual assault should also be sought.&nbsp; Decomposition may render marks difficult, or impossible, to recognize.</p>
<p style="padding-left: 30px; text-align: justify;"><span style="text-decoration: underline;">Mechanism of Death in Neck Compression</span></p>
<p style="padding-left: 30px; text-align: justify;">In hanging, unconsciousness is rapid, due to obstruction of circulation to the brain.&nbsp; Significant obstruction of the carotid arteries can occur with a tension of approximately ten pounds.&nbsp; Vascular obstruction is the main mechanism, leading to death with neck compression.</p>
<p style="padding-left: 30px; text-align: justify;">In ligature and manual strangulation, incomplete carotid occlusion is expected to occur and the struggle may continue for a period of time.&nbsp; This accounts for the injuries and petechial hemorrhages evident at autopsy in strangulation cases.&nbsp; As in all cases of neck compression, the rapidity of death can be effected by susceptibility of the victim to carotid sinus stimulation.&nbsp; Neck holds used by the police may be extremely dangerous and there is some evidence that cocaine intoxication increases susceptibility to sudden cardiac arrest from vagal inhibition.</p>
<p style="padding-left: 30px; text-align: justify;"><span style="text-decoration: underline;">Crush or Traumatic Asphyxia</span></p>
<p style="padding-left: 30px; text-align: justify;">These situations occur when external compression of the chest prevents effective respiratory moments.&nbsp; These deaths are almost always accidental and occur in situations, such as pinning of the victim beneath an overturned car, or in crowds or mob panics.&nbsp; In this category also falls the procedure, "burking".</p>
<p style="padding-left: 30px; text-align: justify;">At autopsy, there is evidence of severe congestion and cyanosis above the level of compression frequently with a sharp line of demarcation.&nbsp; Petechial hemorrhages are prominent and may be confluent above the point of compression.&nbsp; There may be associated sternal, or spinal, fractures and interstitial emphysema.</p>
<p style="padding-left: 30px; text-align: justify;"><span style="text-decoration: underline;">Positional Asphyxia</span></p>

         <title>Whose insurance is responsible in a rollover accident?</title>
         <description><![CDATA[<p style="text-align: justify;"><img style="float: right; margin: 0 0 20px 20px;" title="What say ye!" src="http://www.theiowaedict.com/Oliver%20Twist%20-Cruikshank_-_Fagin_in_the_condemned_Cell_%28Oliver_Twist%29.png" alt="Oliver Twist -Cruikshank_-_Fagin_in_the_condemned_Cell_(Oliver_Twist).png" width="290" height="361" />For today&rsquo;s article we have several real life rollover accidents. The <span style="text-decoration: underline;">first</span> is a 16-year-old driver (<a href="http://wcfcourier.com/news/local/teen-hurt-in-fayette-county-rollover-accident/article_c5c1e096-0fa5-11e1-9ee6-001cc4c03286.html">Beth Opperman</a>) who is said to have suffered only non-life-threatening types of injuries. The Fayette County Sheriff&rsquo;s Office spokesperson described the accident for the WCF Courier as a single vehicle accident where she lost control of her driving on L Avenue north of 110<sup>th</sup> Street, then entered the ditch and the vehicle rolled. There is no discussion as to why or if anyone else was in the Ford Ranger truck. She&rsquo;s just 16 and probably inexperienced so we&rsquo;ll leave it at that.</p>
<p style="text-align: justify;">A <span style="text-decoration: underline;">second roll-over</span> car accident takes place in Chamberlain, S.D. reportedly killing a northwest Iowa man, <a href="http://www.ktiv.com/story/16025655/estherville-ia-man-dies-in-rollover">Leon Contreras</a> of Estherville, Iowa. The driver is described as 37-year-old <a href="http://www.ktiv.com/story/16025655/estherville-ia-man-dies-in-rollover">Ramon Castillo</a>; neither man is described as wearing a seatbelt, although no details are given about what happened to cause the accident.&nbsp;</p>]]><![CDATA[<p style="text-align: justify;">The <span style="text-decoration: underline;">third rollover</span> accident takes place in Wyoming; it involves an oil field worker out of Gillette, Wyoming. The man was involved in a rollover accident where he broke his neck, was taken to the hospital complaining of neck pain and the hospital staff failed to discovery he had a broken neck. He suffered permanent nerve damage because of the delay of two days in diagnosing a broken neck. A malpractice case was filed and the jury returned a $9 million verdict. The man is reported to be <a href="http://www.whbf.com/story/16028323/9m-malpractice-award-thought-to-be-wyos-largest">Louis Prager</a> of Montana.</p>
<p style="text-align: justify;">As you can see each of these rollover case is different; seldom are two the same. <span style="text-decoration: underline;">In the first</span> you have one young driver who could be considered the at-fault driver and with no passengers she would have the only claim. She would file with her own insurance company under the medical pay section of her policy. Beyond getting paid medical bills there is nothing to be paid for personal injury unless she can show there is something wrong with the road, the car she's driving or there is another vehicle with a bad driver.</p>
<p style="text-align: justify;">In the <span style="text-decoration: underline;">second accident</span>, the passenger&rsquo;s estate (he is reported to have died), would file a claim with the driver&rsquo;s auto insurance company and if he has low limits of coverage he may also file with the passenger underinsured motorist coverage policy. Of course if the driver is uninsured and the passenger had automobile insurance then his estate&rsquo;s administrator will file under the uninsured motorist coverage.</p>
<p style="text-align: justify;">In the <span style="text-decoration: underline;">third accident</span> the oil service field worker was in the course of his employment at the time of his rollover accident so he would have several avenues to consider for personal injury coverage. First is the workers&rsquo; compensation insurance and that&rsquo;s an easy one. The second depends on whether he was forced off the road by another car or not. If so then there is a third-party case against the at-fault driver and owner of the at-fault car. The next claim as you can see had to do with his claim of receiving shoddy treatment that fell below the standard of care in Wyoming.</p>
<p style="text-align: justify;">So there you have it three different rollover accidents with three different results and places to file insurance claims. And you wonder why they call this &ldquo;<em>the practice of law</em>&rdquo;? <span style="text-decoration: underline;">Note</span>, the operative word is <em><span style="text-decoration: underline;">practice</span></em>.&nbsp;</p>]]></description>

         <title>The Broadside Auto Accident Case: Was the driver&apos;s view blocked, or was it inattention or could it be speed?</title>
         <description><![CDATA[<p style="text-align: justify;"><img style="float: right; margin: 0 0 20px 20px;" src="http://www.theiowaedict.com/Evidence.jpg" alt="Evidence.jpg" width="300" height="218" />Today&rsquo;s litigation brief looks at a recent accident involving one car pulling out and being broadsided by an oncoming truck; the truck driver appears to have the right-of-way. As a young lawyer you have to ask yourself whether the guy pulling out is completely at fault or whether there is other evidence of negligence.</p>
<p style="text-align: justify;"><strong>Black Hawk County, Iowa</strong> - What caused the driver to not see the oncoming truck and to pull out right in front of it on Highway 63? The accident is described as involving an F-250 Pickup truck and a Toyota Corolla &ndash; a fight weighing heavily in favor of the Ford. The Toyota being driven by one Joseph Pink pulls out from C57 and attempts to cross the southbound lanes of Highway 63 just as Garth Harold Beatty in his 1999 Ford pickup truck towing a trailer is crossing C57 at that intersection. The inevitable occurs with Mr. Beatty&rsquo;s truck t-boning the little Toyota. Apparently Mr. Pink died in the crash and a passenger Mr. Harold Beatty was injured and taken to Allen Hospital. I used to work with a lawyer Sam Beatty in Waterloo. He was really a nice guy; I liked him a lot.</p>]]><![CDATA[<p style="text-align: justify;">What are the right questions to ask from the physical evidence and the eyewitnesses?</p>
<p style="text-align: justify;"><strong>Ten things we want to know from the accident investigation:</strong></p>
<ol>
<li>We would want to know if there was an obstruction to the view of Mr. Pink.</li>
<li>We would want to know the speed of the Beatty truck?</li>
<li>We want to know how long any skid marks are along with where they start and stop.</li>
<li>We want to know the initial point of impact.</li>
<li>We want to know the crush depth into the Toyota.</li>
<li>We want to know if Mr. Pink was distracted while driving.</li>
<li>We want to know if any driver was under the influence of alcohol or drugs.</li>
<li>We want to know the chemical tests from the autopsy report and any administered to the other driver.</li>
<li>We want to view the scene and photograph it.</li>
<li>We want to interview any passengers.</li>
</ol>
<p style="text-align: justify;"><strong>Things to do right now:</strong></p>
<ol>
<li>Get the ISP Technical Investigation Report with Photographs.</li>
<li>Visit the accident scene.</li>
<li>Talk with as many witnesses as you are able.</li>
<li>Photograph the vehicles involved.</li>
<li>Photograph the scene.</li>
<li>Look in the vehicles for evidence showing the whereabouts of the passengers prior to the collision.</li>
</ol>
<p style="text-align: justify;">There are a lot more questions to be answered but this is a start. What we are evaluating is negligence of all drivers and the landowners who have a duty to mow their weeds. Remember right now you want to prove the facts not your case. Your case will be proven, or not, when you gather and preserve the facts.</p>

Out of rage, my employer struck me in the face at work. There has been similar behavior in the past. The police were called and a report was filed. The officers said that the charges would likely stick. Should I seek some sort of civil action against my employer as well? Would I need an employment lawyer or a personal injury lawyer for a case like this?</p>]]><![CDATA[<p style="text-align: justify;"><strong>Answer:</strong> The employer should not have assaulted you and yes his/her behavior is wrong, but what are your damages? Is it worth $1,000 or $500? Is it worth $100? I have no way of knowing, but there is a more important question you need to answer. Why do you want to work there? Beyond the answer to that question one has wonder how long will your employer keep you employed?</p>
<p style="text-align: justify;">You know some problems have no good legal solution and this appears to be one of them. The best answer to your question may lie in a personal solution to which the law is incapable of providing an answer.&nbsp;</p>

<p style="text-align: justify;"><span style="font-size: 9pt; line-height: 115%; font-family: Verdana, sans-serif;"><strong><span style="font-size: 9pt; line-height: 115%; font-family: Verdana, sans-serif;"><strong>Does negligence have to be established in order to collect damages in any personal injury case?</strong></span></strong></span></p>]]><![CDATA[<p style="text-align: justify;"><strong>Answer:</strong> Negligence is a legal concept that establishes whether or not a party can be at fault and thus have to pay for someone else's damages. Yes, you have to prove someone was negligent in order to have any possibility of collecting damages. So what is negligent behavior? Negligent behavior is a breach of a recognized standard created by law, agreement of the parties or recognized behavioral standards.</p>
<p style="text-align: justify;"><strong>Statutes and Black Letter Law:</strong> The statutory law states that everyone must stop at a stop sign. If you run the stop sign you are negligent.</p>
<p style="text-align: justify;"><strong>Common Law:</strong> If you behave in such a way as to increase the risk of injury to another knowing injury is likely then you can be found to have been negligent.</p>
<p style="text-align: justify;"><strong>Contract:</strong> General contractors agree by way of a written agreement (the contract) to supervise the construction site and to make sure every subcontractor is abiding by OSHA's rules and regulations. If the GC knows a sub is not following OSHA rules/regs or fails to monitor whether the subs are adhering to OSHA rules they can be found to be negligent.</p>
<p style="text-align: justify;"><strong>Criminal Law:</strong> Criminal law says if I walk up and punch you in the nose I'm guilty of assault and battery. If I walk up to one guy but hit another due to my being too drunk to make a straight punch, then I'm probably negligent. That's a standard that can be applied to civil law to find you acted negligently.</p>
<p style="text-align: justify;"><strong>Professional Standards:</strong> Professionals are held to a standard created and recognized by other professionals and the associations that govern their conduct.</p>
<p style="text-align: justify;">These are not all the ways standards are found in the civil law, but it will give you some idea of how standards are determined to exist and therefore formulate the basis for determining negligent conduct.&nbsp;</p>]]></description>

<p style="text-align: justify;">In 2009 nationwide, more than 1,700 people died in wrong way crashes. The problem has gotten so bad in Arizona that officials are now testing sensors that will detect if there is a wrong way driver, and notify others on the highway with electronic signs. Highway safety experts say all you can really do if you come in contact with a wrong way driver, is flash your high beams, and try to determine what lane the driver is in. Most often, they'll be in the fast lane, because they think they're in the slow lane.</p>

<p style="text-align: justify;">The truck's driver and two passengers, all from Victoria, Minn., were treated at Ridgeview Hospital in Chaska and released, according to the Chaska Police Department.</p>

<p style="text-align: justify;"><strong>Wrong-way Drivers on the interstate highway</strong></p>
<p style="text-align: justify;">If you think wrong-way drivers on the Interstate Highway system is a once-in-a-while thing, think again. Look at these reports from&nbsp;Google. It seems like there is an epidemic of wrong-way collisions and crashes out there. We've had several wrong-way drivers and accidents in Iowa.</p>
<p style="text-align: justify;"><strong>About wrong-way drivers</strong></p>
<p style="text-align: justify;">Wrong way drivers present an obvious danger to all motorists on our highways.&nbsp;</p>
<p style="text-align: justify;">The most recent available crash statistics from the National Highway Traffic Safety Administration indicates wrong way drivers are involved in 1.5 percent&nbsp;of all fatal crashes.</p>
<p style="text-align: justify;"><strong>Drivers who travel the wrong way on one way highways generally fall into one of eight different categories:</strong><strong>&nbsp;</strong></p>
<ul style="text-align: justify;">
<li>Intoxicated      driver</li>
<li>Older      drivers who easily get confused</li>
<li>Purposeful      acts including attempts to commit suicide and criminals attempting to      elude the police</li>
<li>Inattentive      drivers who mistake an off-ramp for an on-ramp </li>
<li>Mental      defect or disease</li>
<li>Prescription      drug intoxication</li>
<li>Inexperience</li>
<li>GPS      providing incorrect, inaccurate or confusing information</li>
</ul>
<p style="text-align: justify;"><strong>Safety tips and information related to wrong way driver situations:</strong><strong>&nbsp;</strong></p>
<ul style="text-align: justify;">
<li>Watch      far ahead for signs of a possible wrong way driver, looking for signs      similar to pending problems or developing emergency situations such as      other traffic braking or swerving to avoid something, or the obvious -      headlights coming in the opposite direction. </li>
<li>Caution      against driving long periods in the left lane on freeways, especially on      curves and over a hill or any rise in the road where you aren&rsquo;t able to      clearly see ahead. </li>
<li>Be      aware that wrong way drivers usually drive in the passing lane believing      they are actually on a two-lane highway. </li>
<li>The      most common types of wrong way crashes are head-on or sideswipe crashes. </li>
</ul>
<p style="text-align: justify;"><strong>What should you do if you see a wrong-way driver? </strong></p>
<ul style="text-align: justify;">
<li>Get to the shoulder and stop.</li>
<li>If you can&rsquo;t get to the shoulder, slow down and attempt to safely stop your vehicle by pulling to the right.</li>
<li>Sound your horn.</li>
<li>Put on your lights and flash the high beams.</li>
<li>Call 9-1-1.</li>
<li>Before getting in the car wear your seat belts.</li>
<li>Drive in the right hand lane of travel on the Interstate.</li>
<li>When passing or coming to the crest of a hill look ahead for a wrong-way driver making sure the lane is clear.</li>
<li>Assume when in the left hand lane of a divided highway that you may come upon a wrong-way driver.</li>
<li>When driving on a divided highway stay vigilant and pay attention to what is ahead of you. Avoid allowing distractions to take your attention off the road ahead.</li>
</ul>
<p style="text-align: justify;"><strong>How can drivers avoid wrong-way driving?</strong></p>
<ul style="text-align: justify;">
<li>Don&rsquo;t drive drunk.</li>
<li>When coming to a divided highway come to a complete stop, look at and read the signs, making sure you know which way to go.</li>
<li>Don&rsquo;t allow vehicles to the rear to rush you.</li>
<li>Stay off the telephone when driving.</li>
<li>Don&rsquo;t allow distractions to interfere with being vigilant about your driving.</li>
<li>If you&rsquo;re a young driver, don&rsquo;t drive when the other passengers are a distraction.</li>
<li>If you&rsquo;re an elderly driver, get evaluated once a year to see if your senses and skill level allow you to safely drive. Don&rsquo;t be so stubborn about giving up your driver&rsquo;s license that you ignore the signs of perception difficulties. Invest in and use a GPS.</li>
<li>Pay particular attention when driving north for southbound wrong-way drivers. For whatever reason there were more of these direction wrong-way drivers than any other.</li>
<li>Pay particular attention when driving after midnight and 2:30 a.m.</li>
</ul>
<p style="text-align: justify;"><strong>What else needs to happen to reduce wrong-way collisions?</strong></p>
<ul style="text-align: justify;">
<li>States could identify the locations of repeated wrong-way entry points. Those points could be redesigned including tire puncture equipment such as we see in use at most parking ramps.</li>
<li>The Court&rsquo;s must get very tough on drunk drivers and those who cause collisions from being on cell phones (talking or texting); more than they already have been.</li>
<li>The DOT should begin an education campaign for drivers to recognize and avoid wrong-way drivers.</li>
<li>The DOT should begin an education campaign to instruct drivers what to do when a wrong-way driver approaches.</li>
<li>States should further study wrong-way avoidance road and sign designs.</li>
<li>State DOT&rsquo;s should consider a different middle line design with hash marks bent in the direction of travel and against the opposing direction.</li>
<li>Juries in civil actions need to send a clear message to offenders with large punitive damage awards.</li>
<li>The DOT needs to evaluate older drivers annually for visual and mental awareness; taking away driving privileges where there is risk.</li>
<li>Lawyers need to plead punitive damages in wrong-way collisions.</li>
<li>Victims need to be educated on what to do when they are involved in a wrong-way collision.</li>
<li>Witnesses of wrong-way collisions need to get involved with identifying themselves to police officers investigating a wrong-way collision. Those witnesses may have very valuable information to helping identify the entry points, causes and preventive measures.</li>
<li>DOT accident forms need to be amended to allow the collection of information to identify characteristics associated with causing wrong-way entry points, times when wrong-way collisions are most likely to occur and driver characteristics of those likely to drive the wrong-way. Children and friends of older drivers need to get involved with identifying those likely wrong-way drivers.</li>
<li>States should consider a radio system that would allow public service interruptions, like what is done on television when a weather emergency is eminent. It wouldn&rsquo;t be perfect (not all radios are on) but something is perhaps better than nothing.</li>
</ul>

         <title>Creepy Crawly Class Action Certified in Bed Bug&apos;s Treatment Case</title>
         <description><![CDATA[<p style="text-align: justify;">A class action has been certified in Iowa against a lower-income apartment complex by about 300 residents. According to the Des Moines Register article the plaintiffs are asserting claims for &ldquo;<em>back rent, lost property and other hardships because of a bedbug problem stretching back to late 2007.</em>&rdquo; Bed bugs are brought in by a tenant and when discovered the landlord is required to treat the infected areas of the building. Costs can be upwards of $1,000 per apartment. Treatment is by chemical or 120-degree heat. Delaying treatment is really not an option. Companies that manage large complexes are checking for bedbugs at the end of a tenant&rsquo;s lease. The check is made with <a href="http://www.badbedbugs.com/bed-bug-sniffing-dog/">dogs</a> that sniff out their presence by smelling pheromones the bedbugs give off. <p style="text-align: justify;">It may be that checking at the end of each lease term will help identify the host tenant and we may see landlords suing the host tenant to recover the costs associated with cleaning up the building and for lost rents. A clean bill of health via a dog sniffing certification may be required to prove the case.&nbsp;</p>

Which means we have to learn where these cameras are located. As for clients who are in an intersection collision it&rsquo;s better to get a lawyer onboard sooner rather than later. This is also a reason for the lawyers to get out to visit the accident scene. You just never know where a camera may be recording the events. The camera may be on a nearby building used as a security camera.</p>

         <title>Juvenile&apos;s Suicide Costs Iowa $400,000</title>
         <description><![CDATA[<p style="text-align: justify;"><img class="mt-image-right" style="float: right; margin: 0 0 20px 20px;" src="http://www.theiowaedict.com/Lawyer%20running%20to%20court.jpg" alt="Lawyer running to court.jpg" width="400" height="256" />The estate of a teen who died after walking in front of freeway traffic will be paid <a href="http://www.kcci.com/news/29745357/detail.html">$400,000</a> by the State of Iowa. The teen had been in a State of Iowa vehicle being driven by a social worker. According to the news report the teen was being driven to a youth shelter, threatened suicide, prompting the social worker to pull over on I-380. He then exited the car, walked into traffic and the cause was later ruled a suicide.</p>
<p style="text-align: justify;">These are tough cases. I'd like to read that brief.</p>
